New Trial Granted

On July 14, 2022, Federal Judge Linda V. Parker ordered a new trial for our client, Lafayette Upshaw, because his trial attorney failed to present the testimony of his aunt at trial that he was at home with her when the crime occurred.  Judge Parker also ruled that the Wayne County Prosecutor engaged in racial discrimination during jury selection.  Judge Parker agreed with the arguments we made in our briefs both before and after David L. Moffitt's passing.  Judge Parker also relied on the brilliant performance of the Firm's new managing attorney, Tameka L. Tucker, who brought this victory home by brilliantly conducting the evidentiary hearing held in this case in May of this year.

Released on Bond

On January 25, 2022, our client, Mr. Moss, was released  on bond from his 15 to 45 year prison sentence as a result of our win in his case, Moss v Winn, E.D. Mich. No. 18-11697, discussed below.

On March 29, 2022, the St. Clair County Circuit Court granted our motion to re-start the time to appeal the case of our client, Paul Harris, in People v Paul Joseph Harris, Case No. 13-000463-FC.

On March 17, 2022, the Michigan Court of Appeals granted our application for leave to appeal and ordered the Wayne County Circuit Court to reconsider our motion for relief from judgment under MCR 6.500 in People v Campbell, MCOA No. 359494.

On March 14, 2022, the Washtenaw County Circuit Court granted our client Shawn Bell resentencing based on our motion for relief from judgment ("6500 motion") and brief in support in People v Bell, Case No. 17-257-FH.

WE WON DISMISSAL OF FELONY CHARGES

On December 21, 2021, Judge Kenyetta Stanford Jones of the 36th District Court (Wayne County) dismissed charges of armed robbery, carjacking, felonious assault, and felony firearm against our client, Brice Ball, due to our unmatched advocacy and no-holds-barred legal strategy.  Mr. Ball did not spend one day in prison and celebrated Christmas 2021 with his family.

WE WON DISMISSAL OF MARIJUANA CHARGES

In July 2021, the Oakland County Prosecutor voluntarily dismissed drug charges against Donald Barnes after we showed that police officers made false statements in search warrant affidavits.  Our victory made headline, front-page news in the Detroit Free Press on October 12, 2021.

WE WON APPEAL

In June 2021, Omar Pouncy (convicted in 2005 of four counts of carjacking, four counts of armed robbery, two counts of felony firearm, and two counts of felon in possession of a firearm, resulting in a sentence of 48 to 66 years in prison) was granted a chance at much earlier release  by U.S. District Court Judge Matthew F. Leitman due to our effective advocacy.  Agreeing with Pouncy's long-time attorney, David L. Moffitt, Judge Leitman ruled that Pouncy was entitled to the plea bargain that prosecutors originally offered him, a bargain Pouncy would have accepted but for his trial attorney's botched advice.

We win criminal appeals

In September 2013, US District Court Judge Arthur J. Tarnow ordered the immediate release of Alexander Aceval, who was sentenced to at least ten years in prison for possession with intent to deliver 1,000 or more grams of cocaine and had been incarcerated for more than 7 years.  Judge Tarnow ordered Mr. Aceval released after we proved that Mr. Aceval's convictions were based on perjury, police misconduct, prosecutorial misconduct, and misconduct by the trial judge.  See the shocking news report.
